End User License Agreement
LEAP Archery — End User License Agreement
Effective October 24, 2026. Please read this agreement carefully before using LEAP Archery.
1. Parties, Acceptance, and Scope
This End User License Agreement (“Agreement”) is between LEAP Archery LLC (“LEAP,” “we,” “us”) and the person or entity using the LEAP Archery mobile application (“App,” “you”). LEAP Archery was formerly marketed as Pro Archery Ballistics. This Agreement covers the App on iOS and Android, updates, related in-app features, and access provided through subscriptions or lifetime licenses, unless separate signed terms apply. It is not an agreement with Apple Inc. or Google LLC. By installing, accessing, purchasing, or using the App after being presented with this Agreement, you agree to it. If you do not agree, do not use the App. Any mandatory consumer rights remain unaffected.
2. Personal License Grant
Subject to this Agreement and your applicable entitlements, LEAP grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to use the App for your own lawful, personal, noncommercial archery activities. On Apple devices, this license applies to Apple-branded products you own or control, consistent with the Apple Media Services Usage Rules, including permitted Family Sharing or volume purchasing. Sharing permitted by platform rules does not confer a commercial license. No intellectual-property ownership is transferred.
3. Commercial Use and Professional Licenses
Unless LEAP has provided express written commercial authorization, the personal license does not permit use of the App as part of paid or revenue-generating services, including: producing or selling sight tapes for customers; paid bow setup, tuning, or ballistic services; paid instruction or coaching using Shot Doctor, training analysis, or other App functions; preparing customer reports or charging others for App outputs; or sharing one personal subscription among staff as a business tool. Incidental personal use by someone who happens to be employed in the archery industry is not automatically commercial use. Commercial authorization is provided only under a separate written LEAP agreement or expressly designated commercial plan, which identifies authorized activities, seats, devices, term, and conditions. In case of conflict regarding authorized commercial activities, that separate agreement controls. A commercial license does not imply any guaranteed geographic exclusivity or partnership unless expressly stated.
4. Accounts, Devices, and Access
You are responsible for safeguarding credentials and activity under your account, except where attributable to LEAP. Do not sell, transfer, share, or distribute access credentials except as expressly authorized in a commercial agreement or by nonwaivable platform rules. Owner-issued Firebase credentials and manually provisioned lifetime accounts are subject to this Agreement and any written license confirmation. Access may require a supported device, compatible operating system, internet connection for some functions, and valid platform entitlements. LEAP may implement reasonable security checks and prevent unauthorized access, subject to applicable law.
5. Subscriptions, Billing, and Renewals
Paid subscriptions purchased in the App are billed by Apple App Store or Google Play Billing, as applicable. Pricing, trial eligibility (if offered), renewal frequency, taxes, and material terms are shown at checkout. Unless canceled under the store's procedures before the renewal deadline, automatically renewing subscriptions continue at the then-disclosed applicable rate, subject to required notices and applicable law. Manage or cancel subscriptions in the store account used to purchase them; uninstalling the App does not cancel a subscription. Refund requests for in-app purchases are handled in accordance with the relevant store's policies and mandatory law. LEAP does not separately charge customers for store-billed purchases. Rights to paid functionality depend on the purchased entitlement, subject to mandatory law.
6. Lifetime Purchases
An individual lifetime license bought directly from LEAP through its website provides access to the features described at purchase for the useful supported life of the App and service, not for the purchaser's lifetime, and does not guarantee perpetual operation, future feature development, or availability of any third-party service. It is a personal noncommercial license unless expressly labeled commercial. LEAP will not arbitrarily revoke a paid lifetime entitlement, but may suspend or terminate access for material breach, fraud, unlawful conduct, or service discontinuation as permitted by law, subject to required remedies. Any separate written lifetime purchase terms and mandatory consumer protections apply. “Lifetime” never converts a personal entitlement to a commercial one.
7. Archery and Safety Disclosures
The App provides estimation, training, and informational tools for archery, such as trajectory, drop, sight marks, sight tapes, arrow/spine recommendations, environmental corrections, bow tuning guidance, and automated shot or pose analysis. Outputs depend on user inputs, sensor conditions, assumptions, algorithms, device limitations, and external information, and can be wrong. The App is not a calibrated measuring instrument, substitute for manufacturer guidance, substitute for competent instruction, or guarantee of safe or successful shooting or hunting. Before shooting, independently verify range, equipment condition, setup, sight calibration, arrow compatibility, safe backstop, local rules, and calculated marks under controlled and safe conditions. Do not rely on the App where a mistake could create danger. You remain responsible for your equipment, judgment, compliance with hunting regulations, and safe conduct. Nothing in this clause excludes liability that applicable law does not allow to be excluded.
8. Prohibited Conduct and Intellectual Property
You may not copy, resell, sublicense, distribute, make derivative works of, reverse engineer, disassemble, circumvent technical restrictions or access controls, scrape, or commercially exploit the App, its code, artwork, data sets, or proprietary content, except where permitted by law or applicable open-source licenses. You may not use the App unlawfully, infringe others' rights, interfere with services, or misrepresent affiliation with LEAP. The App, LEAP name, logos, interfaces, documentation, and original content remain owned by LEAP or its licensors. Your ownership of your own lawfully created inputs and shooting records is not transferred to LEAP. This restriction does not prevent ordinary permitted personal use of printed sight tapes and exports.
9. Data, Permissions, and Privacy
The App may use information you enter, local device storage, location where you allow it, device audio or camera where you grant permission, and external services needed to perform requested functions. Data practices are governed by the LEAP Privacy Policy published on the LEAP website and linked in the App. Camera, microphone, or location permissions may be denied or withdrawn in device settings, although dependent features may not function. LEAP does not claim ownership of your personal records. You should keep backups of records important to you. This Agreement does not replace the Privacy Policy or authorize processing prohibited by applicable privacy law.
10. Third-Party Services and Terms
The App may link to or depend on Apple, Google, payment stores, mapping, weather, elevation, printing, video hosting, analytics, or other services. Their availability, content, and independent terms may apply. You must comply with applicable third-party terms, including wireless-data and device-service agreements. LEAP does not control third-party content or warrant uninterrupted access to external services. Any external purchases or links remain subject to applicable store policies and law.
11. Updates, Availability, and Changes
LEAP may provide bug fixes, security changes, improvements, or new features and may discontinue specific features or third-party integrations. We will not intentionally remove material paid benefits without considering applicable legal obligations, any promised term, and appropriate notice or remedies. Some functions may be temporarily unavailable. We may revise this Agreement prospectively; for material changes, we will provide notice as required by law and seek agreement where legally necessary. Your existing rights are not retroactively reduced merely because a revised version is posted.
12. Suspension and Termination
You may stop using and uninstall the App at any time; subscription cancellation must also be completed through the relevant billing platform. LEAP may suspend or terminate the license for a material violation, misuse, fraud, security threats, or as otherwise permitted by law. Where appropriate and reasonably practicable, LEAP will give notice and a chance to remedy a breach before permanent termination. Upon termination, you must stop using the App and delete unauthorized copies. Terms intended to survive, including intellectual property, disclaimers, permitted liability limits, and dispute rules, survive. Refund and statutory rights are unaffected.
13. Warranties
To the maximum extent permitted by law, the App and related services are supplied “AS IS” and “AS AVAILABLE,” without implied warranties of merchantability, fitness for a particular purpose, accuracy, noninfringement, or uninterrupted service. This does not disclaim guarantees, consumer remedies, or other rights that cannot legally be excluded. LEAP alone is responsible for legally applicable warranties. For an Apple App Store purchase, if the App fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price for the App, if any, under Apple's applicable policies; to the maximum extent permitted by law, Apple has no other warranty obligation, and LEAP is responsible for any remaining warranty claims.
14. Liability and Claims
To the extent permitted by law, LEAP will not be liable for indirect, incidental, special, consequential, exemplary, lost-profit, or lost-data damages arising from use of or inability to use the App. To the maximum extent legally permitted, LEAP's aggregate liability under this Agreement is limited to the greater of US $100 or the amount you paid LEAP or the applicable App Store for the App or its access during the 12 months before the claim. The limitations do not apply to fraud, willful misconduct, personal injury, gross negligence, violations of mandatory consumer law, or any other liability that law prohibits limiting. LEAP, not Apple or Google, is responsible for addressing product liability claims, regulatory compliance claims, and consumer or privacy claims regarding the App, to the extent legally required.
15. Third-Party Intellectual Property Claims
If a third party claims that the App, or your authorized possession and use of it, infringes intellectual-property rights, LEAP, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim to the extent required under applicable law.
16. Export Controls and Legal Compliance
You represent and warrant that you are not in a country subject to a US government embargo or designated by the US government as a terrorist-supporting country, and that you are not on any US government prohibited or restricted-party list. You must comply with applicable export-control, sanctions, privacy, hunting, and other laws when using the App. This representation applies only as required by applicable law.
17. Apple-Specific Terms
For an iOS installation: (a) this Agreement is only between you and LEAP, not Apple; (b) LEAP alone is responsible for the App, content, maintenance, and support, and Apple has no obligation to supply maintenance or support; (c) your use is limited to Apple-branded products you own or control under Apple's Usage Rules, subject to applicable Family Sharing or volume purchasing permissions; (d) LEAP, not Apple, handles claims relating to the App or your use of it, including product liability, legal/regulatory compliance, and consumer protection claims; (e) LEAP handles third-party infringement claims as described above; and (f) Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, may enforce it against you. Nothing in this Agreement conflicts with Apple's mandatory Usage Rules or reduces legally protected consumer rights.
18. Governing Law and Disputes
Except where mandatory consumer law requires otherwise, this Agreement is governed by the laws of the State of Idaho, USA, without regard to conflicts-of-law principles. Disputes not resolved informally may be brought in competent state or federal courts in Idaho, subject to applicable consumer-protection venue rights and other mandatory law. Before filing a claim, either party may send a written description and allow 30 days for informal resolution, except where urgent relief or statutory deadlines make that impractical. This Agreement does not require arbitration, waive class proceedings, or deprive consumers of mandatory rights.
19. General Provisions
If a provision is unenforceable, it is limited to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver. This Agreement, together with the applicable purchase disclosures, incorporated privacy notice where relevant, and any expressly applicable separate commercial agreement, forms the terms governing licensed use; in a conflict, an express signed commercial agreement controls authorized business use and nonwaivable store/consumer rules prevail. The English version controls except where applicable law requires otherwise. You may not assign this Agreement without LEAP's consent, except as law requires; LEAP may transfer it in a lawful business succession without reducing mandatory rights.
